Prosecutors to seek first-degree murder charge against attorney

Prosecutors will file a motion Monday to amend the charges against attorney Mark Madrigali to first-degree murder in the shooting death of his wife.

The motion will be heard Thursday during Madrigali's pre-preliminary hearing, Chief Deputy District Attorney Mark Pafford said. Prosecutors will ask for an increase in Madrigali's $1,525,000 bail.

Madrigali's wife, Trivia Madrigali, died Wednesday morning and an autopsy determined her death was a result of complications from a gunshot wound she suffered about a month earlier. The coroner's office ruled her death a homicide.

Mark Madrigali, 57, has pleaded not guilty to the current charges of attempted murder, assault with a gun and spousal abuse. Redacted police reports say that Mark Madrigali told officers he accidentally shot his wife.

Bakersfield police responded to the Madrigali residence in northeast Bakersfield at 3:45 a.m. June 10 after Mark Madrigali called 911 and reported the shooting. The reports say officers found him at the front of the house and smelled alcohol on his breath.

Trivia Madrigali was found lying face-down on the living room floor, according to the reports. Her clothing was drenched in blood and a spent shotgun shell was lying next to her.

She was taken to Kern Medical Center in critical condition and suffering from wounds to her chest and damage to several organs, the reports said. The hospital stopped releasing updates on her condition, but Wednesday morning the coroner's office reported she had died in the 7700 block of Ryan Drive.

Friends and family of Trivia Madrigali were quoted in the police reports as saying Mark Madrigali was abusive and drank heavily. Some said he had previously threatened Trivia Madrigali's life.

Madrigali has declined a request to be interviewed by The Californian.
