Defendant pleads no contest to voluntary manslaughter in child's death

A defendant once charged with murder in the death of a 2-year-old boy should be free next month after pleading no contest to voluntary manslaughter.

Joshuae Preston, 32, entered the plea Friday morning and prosecutors dismissed the murder charge and a charge of assault on a child resulting in death or great bodily injury, according to court records.

A trial in January ended with the jury deadlocked 11-1 for not guilty.

Preston was accused of killing Guillermo Alvarez, who in 2009 died of blunt force trauma, according to the coroner's office. Deputies said Preston was the only adult caring for Guilllermo while his girlfriend was at work.

Deputy Public Defender Paul Cadman said Preston should be sentenced to time served on June 20. He said Preston is looking forward to being reunited with his daughter.

"He is saddened by the death of Guillermo but relieved that the nightmare is over, and is very appreciative that 11 out of 12 jurors found him not guilty," Cadman said.
